ORDER

Subject: Collection of Monthly Fees in respeet cf Private Unaided Recognised Schools.

Whereas, this Directorate has received numerous cornplaints from parents/guardians alleging that certain

private unaided recognised schools are compelling parents to make payment of fees on a bimonthly.

quarterly, or advance basis, thercby causing finarcial hardship to the parent community.

And whereas, the Directorate of Education (DoE) had issued Circular No. DE.15(172)/PSB/2016/1671

78 dated 15.02.2019 in compliance with the Order dated 10.04.2013 passed by the Hon'ble High Court

of Delhi in W.P.(C) No. 1128/2010 titled Mr. Rahul Chadha & Ors. vs. Summer Field School & Ors.,

wherein it was, inter alia, directed that private unaided recognised schools shall collect fees on a

monthly basis.

And whereas, it has been brought to the notice of this Directorate that certain private unaided recognised

schools continue to mandate coliection of fees for multiple mnonths, i.e., two months. three months or

more, in a single instalment. thereby compelling parents/guardians to make advance payments.

And whereas. such a practice impOses an undue financial burden upon parents. particularly those

belonging to low and middle-income groups, and runs contrary to the underlying objective of ensuring

equitable and inclusive access to education.

And whereas. the said practice appears to be inconsistent with the aforesaid directions of the Hon'ble

High Court and the instructions issued by the Directorate from time to time, which envisage

convenience, fairness and reasonableness in fee collection.

And whereas. the Directorate of Education is empowered under Section 24(3) read with Rule 50(xviii)

and Rule 43 of the Delhi School Education Act and Rules, 1973, to issue such directions to the private

schools as may be necessary to ensure proper conduct of school management and to protect the larger

interests of students and parents. Further. in case of non-compliance with such directions. this

Directorate is empowered to initiate appropriate action. including withdrawal of recognition of the

school under Section 24(4) of DSEA, 1973. or recommendation for takeover of management of the

school under Section 20() of DSEA, 1973. as the case may be.

In view of the above. andin exercise of the powers conferred upon the Director of Education under

Section 24(3) read with Rule 50(xviii) and Rule 43 of the Delhi School Education Act and Rules, 1973.

all Private Unaided Recognised Schools in the National Capital Territory of Delhi are hercby directed as

follows:

No school shall, in any manner whatsoever, mandate, require, or compel any parent or guardian

(i to pay fees for a period exceeding one calendar month in a single instalment. It is. however.

clarified that parents or guardians who, of their own volition and without any coercion, pressure. or inducement, find it convenient to pay fees for more than one monih in a single instalment may be permitted to do so.

ii) No school shall compel, coerce, or require parents/guardians to deposit fee for more than one month at a time as a pre-condition for admission, continuation of enrolment, or any other

benefit or service extended to the student.

ii) Every school shall display this Order prominently on its notice board and upload the same on

its official website within seven (7) working days of its receipt.

Al Managers/Heads of Schools of Private Unaided Recognised Schools are hereby directed to ensure

strict compliance of the above directions. Non-compliance of this Order shall be viewed seriously and

tbis Directorate shall proceed to take appropriate action under the applicable provisions of the Delhi

School Education Act, 1973 and the Delhi School Education Rules, 1973.
